Mediation & Conflict/ Dispute Resolution

Jessica is an AMDRAS Accredited Mediator and has three core focus areas in which she mediates matters;

  • Workplace: Employment relationship matters, harassment, bullying, performance issues, redundancy, team conflicts, return-to-work. Employment or workplace mediation can help when there is a dispute or ongoing conflict in the workplace.
  • Healthcare: Disputes within healthcare settings or patient/provider conflicts. Mediation and facilitated negotiation of matters in insurance and healthcare, the dissolution of private medical partnerships, internal staff disputes in both public and private clinical setting and doctor/patient fee disputes with private providers.
  • Media, Entertainment and Arts Industry: Using the meditation process to resolve disputes within the industry (e.g., between artists, studios). Facilitating disputes and contract negotiations between artists, networks, studios, and performing arts companies.

Mediation is where an independent mediator helps resolve an employment relationship problem in a semi-formal and confidential environment. A mediator will help you to identify the main issues and find potential solutions. Workplace mediation is a confidential and structured process used to help organisations resolve workplace issues and conflict. Acting as an independent and impartial third party, we help to facilitate open discussions between employees, supporting them to defuse difficult situations and resolve disagreements.In a workplace mediation, the parties are assisted by an independent mediator who helps them negotiate and reach agreement on the issues in dispute. The mediator’s role is to assist the parties in reaching their own solutions to problems rather than imposing his or her own solution on them. Workplace Mediation is a form of workplace conflict resolution.

Mediation is a confidential process where an independent and impartial third person (Mediator) facilitates communication between two or more people in a dispute, to assist them in developing mutually acceptable agreements to improve their future working relationship. The process is structured and voluntary, and provides fast, creative, and mutually satisfactory resolutions.

Mediation may be appropriate in a variety of situations, including:

Parties to a grievance are willing or prefer for a matter to be dealt with through a mediated process

The matters are a result of misunderstanding, personality clashes or a difference of opinion

Working and communication style differences

Management of grievances

Changing work practices

The matter can realistically be resolved through mediation

Key features of Mediation

The session is facilitated by a professional impartial third person (Accredited Mediator)

Each participant will meet separately with the mediator for a preliminary meeting, to discuss and prepare for the joint mediation meeting

The mediation session is confidential

Participation is voluntary, with the option to withdraw at any time

The mediation session is structured to encourage constructive communication and clarification of the main issues and assist participants to generate mutually acceptable agreements as to the way forward

Documentation of the agreement between the participants

Mediation is an informal process that can be utilised to deal with workplace conflict quickly and efficiently, through a neutral impartial mediator, helping people talk about difficult issues, through respectful use of language to find workable, future focused solutions.
